1. Acceptance
By accessing DiveVerge.com or purchasing a DiveVerge product, you agree to these Terms. Do not use the service if you do not agree.
2. Digital products
DiveVerge sells downloadable colour-grading assets, including LUT files, guides, and related materials. Product descriptions identify the intended cameras, profiles, software compatibility, and included files. Results vary with exposure, white balance, depth, visibility, lighting, camera profile, and editing workflow.
3. Licence
Unless a product page states otherwise, a purchase grants one purchaser a non-exclusive, non-transferable, revocable licence to use the files in personal work, social-media content, monetised content, and client projects.
You may not resell, redistribute, sublicense, share, publish, upload, reverse-engineer for redistribution, or include the original files in another template, pack, membership, marketplace, training download, or competing product. Team or multi-user use requires written permission or an appropriate multi-seat licence.
4. Account and order security
Secure download links are tied to a completed Stripe order. You are responsible for protecting your receipt, Checkout Session link, email account, and downloaded files. Automated scraping, link sharing, access-control bypass, or unauthorised redistribution is prohibited.
5. Payments
Payments are processed by Stripe. Prices and currencies are shown before checkout. Taxes, exchange charges, or bank fees may apply depending on your location and payment provider.
6. Support and compatibility
We provide reasonable support for download access and installation. You remain responsible for confirming that your device, editor, camera profile, and software version support the advertised file format. Software and camera manufacturers may change menus, colour science, or compatibility through updates.
7. Intellectual property
DiveVerge branding, website content, product files, designs, written guides, and original materials remain the intellectual property of DiveVerge Studio or the relevant rights holder. No ownership is transferred through purchase.
8. Prohibited conduct
- Attempting to access products without valid payment.
- Sharing or selling download URLs or product files.
- Interfering with the website, APIs, payment flow, or security controls.
- Using the site for unlawful, deceptive, abusive, or infringing activity.
- Making false claims that a DiveVerge product guarantees a specific commercial result.
9. Disclaimers
Digital products and the Smart LUT Analyser are provided on an “as available” basis. The analyser offers a rules-based recommendation, not a scientific depth measurement, camera-identification system, or guaranteed grading result. Always preserve original footage and test adjustments on copies.
10. Liability
To the maximum extent permitted by applicable law, DiveVerge Studio is not liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of the site or products. Any aggregate liability connected with a purchase will not exceed the amount paid for that specific product, except where such limitation is prohibited by law.
11. Suspension and termination
Access may be suspended or revoked where there is credible evidence of fraud, chargeback abuse, unauthorised redistribution, security interference, or material breach of these Terms.
12. Changes
We may update these Terms for operational, product, or legal reasons. Changes apply prospectively from the updated effective date, except where immediate action is required for security or legal compliance.
